Virginia's Wrongful Death Act
Virginia's Wrongful Death Act (Virginia Code § 8.01-50) allows the personal representative of a deceased person's estate to bring a civil lawsuit against the party or parties responsible for the death. The proceeds of a successful wrongful death claim are distributed to the statutory beneficiaries — typically the surviving spouse, children, and other close family members.
Recoverable damages under Virginia's Wrongful Death Act include sorrow, mental anguish, and solace; loss of income, services, protection, care, and assistance; medical expenses incurred before death; and reasonable funeral expenses.
